These Terms of Service ("Terms") govern your use of the Passiro website and accessibility scanning platform operated by Passiro ("we", "us", "our"). By accessing or using our services, you agree to be bound by these Terms.

1. Services

Passiro provides automated website accessibility scanning, compliance reporting, AI-powered fix recommendations, hosted accessibility statements, and compliance badges. Our services help you identify and address web accessibility issues in accordance with WCAG and the European Accessibility Act (EAA).

2. Account Registration

  • You must provide accurate, complete, and current information when creating an account.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately of any unauthorized use of your account.
  • You must be at least 16 years of age to create an account.

3. Free and Paid Plans

Free scans

We offer limited free accessibility scans without requiring an account. Free scans are subject to limitations on the number of pages scanned and features available. We reserve the right to modify or discontinue free scans at any time.

Paid subscriptions

  • Paid plans are billed monthly or annually at the rates displayed on our pricing page.
  • Subscriptions automatically renew unless cancelled before the end of the billing period.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
  • We do not provide refunds for partial billing periods.
  • We reserve the right to change pricing with 30 days' notice.

4. Acceptable Use

You agree not to:

  • Scan websites you do not own or have authorization to scan
  • Use our services to harass, harm, or interfere with other websites or their operators
  • Attempt to circumvent plan limitations or usage restrictions
  • Reverse engineer, decompile, or attempt to extract the source code of our software
  • Use our services for any illegal purpose or in violation of any applicable laws
  • Resell, redistribute, or sublicense our services without our written consent
  • Overload our infrastructure with excessive automated requests beyond normal usage

5. Website Scanning

  • Our scanner accesses publicly available web pages using a clearly identified user agent ("Passiro Bot/1.0").
  • Our scanner respects robots.txt directives and limits request rates to avoid impacting website performance.
  • Scan results are provided for informational purposes and do not constitute legal advice or a guarantee of compliance.
  • You are responsible for verifying scan results and implementing fixes on your own websites.

6. Hosted Accessibility Statements

  • If you use our hosted accessibility statement feature, we host a publicly accessible page at passiro.com/s/{your-slug} containing your compliance information.
  • You are responsible for ensuring the accuracy of the information in your statement, including contact details and company information.
  • Depending on your plan, the statement may include Passiro branding ("Powered by Passiro").
  • We may cache statements and update them automatically when new scan results are available.

7. Compliance Badges

  • Compliance badges display your current accessibility score and are updated automatically.
  • We collect anonymous impression and click data for badges to provide analytics.
  • Badge data is served from our infrastructure. We aim for high availability but do not guarantee uninterrupted service.
  • If badge service is temporarily unavailable, badges are designed to fail silently without affecting your website's performance.

8. AI-Powered Recommendations

Our platform uses artificial intelligence to generate fix suggestions for accessibility issues. These recommendations are provided as guidance and may not be complete or applicable to every situation. AI-generated suggestions do not constitute professional advice. You should verify all recommendations before implementing them.

9. Intellectual Property

  • All content, software, designs, and trademarks on passiro.com are owned by Passiro and protected by applicable intellectual property laws.
  • You retain ownership of your own website content and data. You grant us a limited license to access and process your website content solely for the purpose of providing our scanning services.
  • Scan reports, accessibility statements, and badge designs generated by our platform may be used by you in connection with your websites.

10. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, whether express or implied. Specifically:

  • We do not warrant that our scans will identify all accessibility issues on your website.
  • We do not guarantee that following our recommendations will achieve full WCAG or EAA compliance.
  • Automated scanning tools, including ours, typically identify 30-40% of accessibility issues. Manual testing and expert review are necessary for comprehensive compliance.
  • Our compliance scores are based on automated analysis and should not be relied upon as the sole measure of accessibility.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Passiro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use our services.

Our total liability for any claim arising from these Terms or our services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold Passiro harmless from any claims, damages, losses, and expenses (including legal fees) arising from your use of our services, your violation of these Terms, or your violation of any third-party rights.

13. Termination

  • You may close your account at any time by contacting us.
  • We may suspend or terminate your account if you violate these Terms or engage in conduct that may harm our services or other users.
  • Upon termination, your access to the platform will cease and your data will be deleted in accordance with our Privacy Policy.
  • Provisions that by their nature should survive termination will remain in effect.

14. Governing Law

These Terms are governed by the laws of Denmark. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Denmark.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and, where appropriate, by email. Continued use of our services after changes constitutes acceptance of the updated Terms.
